Hamilton Wingo partners Chris Hamilton and Ray Khirallah are proud to have worked alongside the Massachusetts Attorney General’s Office to obtain a victory in a Medicaid fraud case recently featured in the Massachusetts Lawyers Weekly.
The case was filed against private equity firm, HIG Capital, and former executives of South Bay Mental Health Center, Inc. after a whistleblower reported that South Bay was submitting fraudulent claims to the State’s Medicaid program, MassHealth. Between 2009 and 2017, South Bay received over $125 million from MassHealth as a result of its false claims.
The case recently ended in the largest settlement of its kind. “The $25 million False Claims Act settlement is reportedly the largest to date in which a private equity firm has paid to resolve allegations of health care fraud by one of its portfolio companies,” a Massachusetts Lawyers Weekly staff member said in December. “The settlement is also reportedly one of the largest FCA settlements involving allegations of fraudulent billing for mental health services.”
